1. Introduction
Thank you for visiting imaginai.me (the “Site”). The Site and its AI image-generation tools (collectively, the “Service”) are operated by Paradoxeer s.r.o., a company registered in the Czech Republic (Reg. No. 23375141) with its registered office at Dandova 2619/13, Horní Počernice, 193 00 Praha, Czech Republic (“ImaginAI”, “we”, “us”, “our”).
By opening an account or using the Service you accept these Terms of Service (the “Terms”). If you do not agree, please do not proceed. Questions: better@imaginai.me.
2. What We Provide
ImaginAI lets you submit prompts to generative-AI models and obtain AI-created images. You can download results immediately or store them in your account. Unless we agree otherwise in writing, the Service is for private, non-commercial use.
3. Who May Use the Service
Minimum age & capacity. You must be at least 18 and legally able to enter contracts where you live.
Restricted locations. You may not access the Service from any location subject to EU/Czech sanctions or comparable legal restrictions.
Accurate details. All data you supply for your account (the “Account”) must be true, current and complete; keep it updated. You are responsible for your password and all actions in your Account. Tell us immediately about any unauthorised use.
4. Balance, Pricing & Payments (No Credits)
Top-up wallet. The Service works from a prepaid balance (“Balance”) in euros (EUR). You can TOP UP using the payment methods shown at checkout. Minimum top-up per transaction: €5. We do not pay interest on balances.
Per-request charges. Each image request shows its exact price before you submit:

New Request (standard): e.g., €0.88 per generation (illustrative).

Premium Request (advanced parameters): e.g., €3.00 per generation (illustrative).
Actual prices depend on options you choose and are displayed in the interface before you confirm.
Authorisation & deduction. By clicking Generate/Submit, you authorise us to deduct the displayed amount from your Balance immediately. If your Balance is insufficient, the request will not run until you top up.
Checkout info & invoices. Before paying a top-up you will see the total including any applicable taxes. A VAT invoice/receipt is emailed after each successful top-up.
Consumer notice (digital content). By starting an image generation you request immediate performance and acknowledge that the usual 14-day withdrawal right does not apply once generation begins (Czech Civil Code § 1837(l)).
Price changes. We may update prices at any time; changes apply only to future requests and future top-ups.
Top-up finality. Top-ups are final and non-refundable except where required by law. (This does not affect the separate rules below for faulty output or service outages.)
5. Refunds & Service Credits (Images Only)
Corrupted/unreadable file. Notify us within 14 days; we will re-issue the file or, if that is impossible, re-credit your Balance for that generation.
Extended outages. If a platform-wide outage prevents image generation for over 48 consecutive hours and you hold unused paid Balance, we will credit your Balance with an equivalent amount on request.
No change-of-mind refunds. We do not refund simply because you dislike an image’s style or no longer need it.
6. Permitted and Prohibited Uses
You must not:

use the Service for anything unlawful;

create, upload or share hateful, obscene, defamatory or infringing material;

violate others’ IP or privacy rights;

introduce harmful code, disrupt, probe or attempt unauthorised access;

reverse-engineer or tamper with the Service;

bypass Balance checks or security measures.
Breaches may lead to content removal, account suspension/termination and, where appropriate, reporting to authorities.
7. Your Images and Our Limited Licence
Ownership. Subject to any third-party rights, you own the lawful rights in the AI-generated images you create (“User Content”).
Licence to ImaginAI. You grant us a worldwide, non-exclusive, royalty-free licence to host, back-up, display and technically adapt your User Content solely to operate and improve the Service.
Your assurances. Your prompts and images must be lawful and non-infringing.
Originality not guaranteed. AI outputs may resemble existing works. You are responsible for any IP clearance, fact-checking and compliance before publishing or commercial use.
8. Our Intellectual Property
All software, models, designs, trade marks and other materials we provide (“ImaginAI Materials”) are our exclusive property or that of our licensors. Except as allowed in § 7, no licence is granted. You may not copy, modify or create derivative works from ImaginAI Materials without prior written consent.
9. Changes to Service or Terms
We may update, suspend or end any feature at any time. Where a change materially disadvantages users, we will give reasonable advance notice via email or in-app message. Continued use after the effective date means you accept the revised Terms.
10. Disclaimers
The Service and all image outputs are supplied “as is” and “as available.” To the extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. No advice or information creates any warranty unless expressly stated here.
11. Limitation of Liability
Nothing limits liability for death or personal injury caused by negligence, fraud or any liability that cannot be limited under Czech law.
Subject to the foregoing, our total liability for direct damages will not exceed the amount you paid to us in top-ups in the 12 months before the event. We are not liable for indirect or consequential losses, including lost profit, data or reputation.
12. Indemnity
You agree to indemnify and hold harmless ImaginAI, its officers, employees and affiliates from any claim, loss or expense arising from (a) your use of the Service, (b) your breach of these Terms, or (c) infringement of others’ rights by your prompts or images.
13. Governing Law & Disputes
These Terms are governed by Czech law. The courts of Prague have exclusive jurisdiction over disputes related to these Terms or the Service. EU/EEA-resident consumers may also bring proceedings in their home country and may use the EU Online Dispute Resolution platform.

15. Miscellaneous
Entire agreement. These Terms supersede all prior agreements about the Service.
Severability. If any part is invalid, the remainder stays in force.
No waiver. Failure to enforce any clause is not a waiver.
Assignment. You may not assign your rights without our consent. We may assign ours in connection with a business reorganisation.
